Acceptance of Terms

These Terms of Service ("Terms") govern your relationship with LVB BodySculpt & MedSpa ("LVB," "we," "us," or "our"), located at 3650 Hill Blvd, 2nd Floor, Jefferson Valley, NY 10535. They apply when you book or receive services, visit our website at lvbbodysculpt.com, use our online booking application at lvb-booking.web.app/book/, or communicate with us by phone, text, or email.

If you do not agree with these Terms, please do not book or use our services. Continued use of our website, booking app, or services after any update to these Terms constitutes acceptance of the revised Terms.

Services Offered

LVB is a medical spa providing aesthetic, wellness, and recovery services performed by licensed professionals at our Jefferson Valley, NY location. Our services include, without limitation:

• Lymphatic drainage massage — post-operative recovery, postpartum, facial, and chronic-condition support, performed by an RN under medical direction
• Body sculpting and contouring — non-surgical fat reduction, skin tightening, and related treatments
• Facials and skin care — HydraFacial, microneedling, peels, and related aesthetic services
• Wellness services — IV therapy, light therapy, peptides, and related programs
• GLP-1 medical weight management — provided under medical oversight

All services are provided by appointment. Service availability, pricing, and protocols may change without notice. Specific service descriptions and current pricing are available on our website and at the time of consultation.

Booking, Cancellation & No-Show Policy

Appointments may be booked online at lvb-booking.web.app/book/, by calling (914) 639-2429, or in person at our front desk. To secure an appointment, you may be asked to provide a valid credit card to authorize a hold; the hold itself is not a charge.

By confirming a booking, you accept the reservation policy presented at the final booking step, which describes our cancellation, rescheduling, and no-show terms. The reservation policy is part of these Terms and applies to every appointment. Late cancellations or no-shows may result in a fee charged to the card on file, as disclosed in the reservation policy.

Please arrive on time. Late arrivals may shorten your service or require rescheduling at our discretion.

SMS / Text Messaging Communications

If you provide your mobile phone number when booking, signing up at lvb-booking.web.app/book/, or by giving verbal consent over the phone or in person, you may receive transactional SMS messages from LVB — appointment confirmations, 24-hour and 1-hour reminders, post-visit follow-ups, and rescheduling notifications.

Message frequency varies based on your appointment activity. Msg & data rates may apply. Reply STOP at any time to opt out of all SMS, or reply HELP for assistance. SMS consent is never a condition of receiving service.

Mobile information (including phone numbers and SMS opt-in status) will not be sold, rented, or shared with third parties or affiliates for marketing or promotional purposes. Information sharing with subprocessors (e.g., Twilio, our SMS delivery provider) is permitted solely to deliver the SMS service itself, and these subprocessors are contractually prohibited from using the information for any other purpose.

Payment & Pricing

Payment is due at the time of service unless otherwise agreed in writing. We accept major credit cards and other payment methods displayed at our front desk. Pricing is subject to change without notice.

LVB frequently offers consultations free of charge and runs limited-time promotions. Promotional pricing applies only to the specific service, period, and conditions described in the promotion and cannot be combined with other offers unless explicitly stated.

Packages and pre-paid sessions are non-refundable except where required by law. Unused sessions remain valid as described at the time of purchase.

Medical Disclaimer

The information on our website and in our communications is for general informational purposes only and does not constitute medical advice. Content related to health, wellness, or specific treatments is not intended to diagnose, treat, cure, or prevent any disease or medical condition.

Always consult a qualified healthcare professional before starting any new treatment, discontinuing existing treatment, or making healthcare decisions. Individual results from any service vary. LVB services are provided under the medical oversight of our Medical Director, Dr. Mrudangi Thakur, MD.

You are responsible for disclosing accurate and complete medical history, allergies, and current medications before any service. Failure to do so may affect your eligibility for treatment and limits LVB's responsibility for any resulting outcome.

User Responsibilities

When using our website, booking app, or services, you agree to:

• Provide accurate, complete, and current information when booking, completing intake forms, or contacting us
• Not impersonate another person or use someone else's account or contact information
• Not interfere with the security or operation of our website, booking application, or systems
• Use our services only for lawful purposes and in accordance with these Terms
• Comply with all reasonable instructions given by LVB staff during your visit

Intellectual Property

All content on this website — including text, graphics, photos, logos, and the "LVB Body Sculpt MedSpa" name and trademarks — is owned by or licensed to LVB and is protected by U.S. and international copyright and trademark laws. You may not copy, reproduce, distribute, or create derivative works from our content without our prior written permission, except for personal, non-commercial use.

Limitation of Liability

To the fullest extent permitted by applicable law, LVB BodySculpt & MedSpa, its owners, employees, and contractors shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of our website, booking application, services, or communications — even if we have been advised of the possibility of such damages.

Our total liability for any claim arising out of or related to these Terms or your use of our services shall not exceed the amount you paid LVB for the specific service giving rise to the claim. Nothing in these Terms limits liability that cannot be limited under applicable law.

Indemnification

You agree to defend, indemnify, and hold harmless LVB BodySculpt & MedSpa, its owners, employees, contractors, and Medical Director from and against any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your violation of these Terms; (b) your misuse of our website, booking application, or services; or (c) your violation of any applicable law or the rights of any third party.

Modifications to These Terms

We may update these Terms of Service from time to time. The updated version will be indicated by an updated "Last Updated" and "Effective" date at the top of this page. Material changes will be posted on this page with a reasonable notice period where required by law. We encourage you to review these Terms periodically.

Governing Law & Jurisdiction

These Terms are governed by and construed in accordance with the laws of the State of New York, without regard to its conflict-of-laws principles. Any dispute arising out of or related to these Terms or your use of our services shall be brought exclusively in the state or federal courts located in Westchester County, New York, and you consent to the personal jurisdiction of those courts.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining Terms shall otherwise remain in full force and effect.
